Baykeeper Threatens Suit Over Balloon Tract
Road Work
The Times-Standard
4/10/07
EUREKA -- The environmental group Humboldt Baykeeper has threatened
to sue Security National over alleged federal clean water violations
during its recent efforts to rebuild roads on the Balloon Tract
in Eureka.
The notice of intent to sue comes just over two
weeks after the California Coastal Commission stopped the work.
The road work was occurring within 50 feet of environmentally sensitive
areas, the commission said at the time.
Baykeeper alleges that Security National and the subsidiary that
is hoping to build the Marina Center complex on the property failed
to get the proper permits and didn't take measures to prevent pollution
from the road work. Polluted storm water runoff may affect Clark
Slough, the bay, the underground aquifer and wetlands there, the
group contends.
Security National has said it believed the work
to improve emergency access to the plot was exempt, and was prompted
by requests from police and fire departments who were concerned
about the ability to roll equipment onto the property if needed.
